A natural person is considered identifiable if they can be identified, directly or indirectly, by reference to information such as a name, identification number, online identifier, location data or other information relating to that person.

1.4. “Data Controller”

“Data Controller” means LINKORA TECHNOLOGIES LTD, a company incorporated in the United Arab Emirates, which determines the purposes and means of processing Personal Data in connection with Fork.

1.5. “Processing”

“Processing” means any operation or set of operations performed on Personal Data, whether by automated means or otherwise, including collection, recording, organization, structuring, storage, alteration, retrieval, consultation, use, disclosure, transmission, dissemination, restriction, erasure or destruction.

1.6. “Services”

“Services” means the functionality and features made available through Fork, including account-related functionality and any additional features introduced by the Company from time to time.

1.7. “Third Party”

“Third Party” means any person or entity other than the User, the Company and persons acting on behalf of the Company.

2. Scope of This Privacy Policy

This Privacy Policy applies to Personal Data processed by the Company in connection with Fork.

It describes:

  • the types of Personal Data we collect and process;
  • the purposes for which we use Personal Data;
  • the legal bases on which we rely when processing Personal Data;
  • how we store and protect Personal Data;
  • when and with whom we may share Personal Data;
  • how international transfers of Personal Data are handled;
  • how long we retain Personal Data;
  • your rights in relation to your Personal Data; and
  • how you can contact us about privacy matters.

Fork is a third-party Telegram client that interacts with Telegram’s services. Telegram independently processes Personal Data and determines the purposes and means of such processing in accordance with its own Privacy Policy, available at https://telegram.org/privacy.

3. Personal Data We Collect

We collect and process Personal Data that is reasonably necessary to provide, maintain, secure and improve Fork and its features.

The types of Personal Data we process depend on how you use Fork and which features you choose to enable.

3.1. Account and Identification Data

When you create or access an account, we may process information needed to register and maintain your account, including:

  • your mobile phone number;
  • your account or user ID;
  • your username, if you choose to set one; and
  • authentication and verification information.

Your login code and two-step verification password are sent directly to Telegram to sign you in. Fork does not store them.

We do not require your display name or username to be your real name.

3.2. Technical and Device Information

When you use Fork, we may automatically collect certain technical information needed to operate, secure and improve Fork, including, where applicable:

  • IP address;
  • device type and model;
  • operating system and version;
  • Fork version;
  • device identifiers;
  • language and regional settings;
  • date and time of connection; and
  • crash reports, diagnostic information and technical logs.

Where appropriate, we may use technical information in aggregated, anonymized or pseudonymized form for analytics, security, troubleshooting and product development.

3.3. Information You Choose to Provide

You may voluntarily provide additional Personal Data when using certain features or contacting us, including:

  • additional profile information;
  • information included in requests to customer support;
  • feedback, complaints or other communications;
  • information required to use optional features; and
  • information you provide when participating in surveys, promotions or other activities.

You are generally free not to provide optional information. However, certain features may not be available without the information required to provide them.

3.4. Contacts and Address Book Information

Some features of Fork may allow you to synchronize contacts stored on your device.

If you choose to use such a feature and grant Fork the relevant device permission, we may access and process contact information available through your device's address book, such as names and telephone numbers.

We will not access your device contacts unless you grant the relevant permission.

You may disable contact access through your device settings. Where Fork provides a separate contact synchronization setting, you may also disable synchronization in Fork.

3.5. Location Information

If you share your location in a chat, Fork sends it to Telegram, which processes it under its own Privacy Policy. Fork does not store your location.

If you choose to share your live location in a chat, Fork accesses your device's location in the background, including when the app is closed, for the period you choose, so that the chat keeps receiving your location. Fork shows a notification while sharing is active. Sharing stops when the period ends or when you stop it. Fork does not access your location in the background for any other purpose.

We will request access to your device's location only where such access is necessary for a feature you choose to use. Where required by applicable law or the operating system, we will request your permission before accessing location information.

If you do not enable a location-based feature or grant the relevant permission, Fork will not access your precise device location for that feature.

3.6. Gaming Profile and Other Fork Features

When you use features operated by the Company, we process the information you provide in them:

  • your gaming profile: the platforms you play on, your favorite games, your Game Online status and how long it is shown, the text in your thought bubble, your profile color, your achievements and your visibility settings;
  • Voice Rooms: the names and emoji of rooms you create, the rooms you join and the invitation links you share;
  • the gaming feed: the channels you add to or remove from your feed; and
  • invitations to Fork that you send.

Other Users can see your gaming profile according to your visibility settings. Calls in Voice Rooms are carried by Telegram; the Company does not record or store their audio.

3.7. Device Permissions

Fork asks for access to your camera, microphone, photos and files, contacts, location or notifications only when you use a feature that needs it, such as sending media, recording voice messages, making calls, finding contacts or sharing your location. Content you send this way is transmitted to Telegram as described in Section 7.2. You can change these permissions at any time in your device settings.

3.8. Children

Fork is not intended for children under 16. We do not knowingly collect Personal Data from children under 16. If we learn that a child under 16 has provided Personal Data to us, we will delete it and close the related Fork account. If you believe that a child under 16 uses Fork, contact us at supp@fork.talk.

4. Biometric and Genetic Data

We do not intentionally collect or process biometric or genetic Personal Data for the purpose of uniquely identifying Users.

Fork does not require facial recognition, fingerprint recognition, voice recognition or other biometric identification as a condition of registration or ordinary use of the Services.

If we introduce a feature that requires the processing of biometric or genetic Personal Data, we will provide appropriate information and obtain any consent required by applicable law before such processing begins.

5. How We Use Personal Data

5.4. Improving and Developing Fork

We may use technical, aggregated, anonymized or pseudonymized information to:

  • understand how Fork is used;
  • identify and resolve technical issues;
  • improve performance and reliability;
  • develop new features;
  • test existing and new functionality; and
  • improve the overall User experience.

Where reasonably possible, we will use aggregated, anonymized or pseudonymized information for these purposes.

To count how many people use Fork, we record when your account opens Fork. These records are linked to your account. We delete them within 30 days after you delete your Fork account.

5.5. Legal and Regulatory Compliance

We may process Personal Data where necessary to:

  • comply with applicable laws and regulations;
  • respond to lawful requests from competent authorities;
  • establish, exercise or defend legal claims;

Our legitimate interests may include operating, maintaining, securing and improving Fork, preventing fraud and abuse, protecting our systems, and defending our legal rights.

6. Legal Basis for Processing Your Personal Data

We process your Personal Data on one or more of the following legal bases, depending on the nature and purpose of the relevant processing:

Performance of a contract. We process your Personal Data where such processing is necessary for the performance of our agreement with you, including to provide, operate, maintain and support Fork, authenticate your account, and provide the functionality you have requested.

Consent. We process your Personal Data on the basis of your consent where consent is required by applicable law or where we otherwise request and obtain your consent for a specific processing purpose. You may withdraw your consent at any time where permitted by applicable law. Withdrawal of consent does not affect the lawfulness of processing carried out before such withdrawal.

Legitimate interests. We process your Personal Data where such processing is necessary for our legitimate interests, including:

  • providing effective, reliable and innovative Services to our Users;
  • maintaining, improving and developing Fork and its Services;
  • detecting, preventing and addressing fraud, abuse, security incidents and other threats to the security or integrity of our Services; and
  • protecting our rights, property and Services and ensuring their proper operation,

provided that such interests are not overridden by your interests or fundamental rights and freedoms that require protection of your Personal Data.

Legal obligations. We process your Personal Data where such processing is necessary for compliance with a legal or regulatory obligation to which we are subject, including responding to lawful requests from competent authorities, complying with applicable laws and regulations, and establishing, exercising or defending legal claims where required by law.

7. How We Share Personal Data

We do not sell your Personal Data.

We may disclose or otherwise make Personal Data available to Third Parties where this is necessary to provide the Services, where you have requested or authorized such disclosure, or where disclosure is permitted or required by applicable law.

Where such providers process Personal Data on our behalf, they will be authorized to process it only as necessary to provide the relevant services and subject to appropriate contractual and security safeguards that require them to provide the same or equal protection of Personal Data as described in this Privacy Policy.

At the time of this Privacy Policy, these providers include:

  • Google Firebase (Google LLC), which we use to deliver push notifications and collect crash reports; and
  • Scaleway, which hosts our servers in the Netherlands.

We do not use advertising identifiers, such as Apple's IDFA or the Android Advertising ID, and we do not track you across apps and websites owned by other companies. If we start to do so, we will update this Privacy Policy before the change and ask for your permission where the law or your device's operating system requires it.

7.2. Telegram and Related Services

Because Fork is a Telegram client, its messaging features work through Telegram’s services and infrastructure. When you use these features, information such as your messages, media, and contacts is transmitted to and processed by Telegram.

Any Personal Data or other information transmitted to Telegram or otherwise processed by Telegram is subject to Telegram’s own Privacy Policy and Terms of Service.

7.3. Legal and Regulatory Authorities

We may disclose Personal Data where required or permitted by applicable law, including in response to:

  • a court order;

  • a regulatory requirement; or
  • another legally binding process.

Where permitted by law, we will limit such disclosures to the information reasonably necessary for the relevant purpose.

7.4. Corporate Transactions

If the Company is involved in a merger, acquisition, reorganization, financing, sale of assets or similar corporate transaction, Personal Data may be transferred as part of that transaction, subject to applicable law and appropriate safeguards.

7.5. Sponsored Messages in Telegram Channels

As required by Telegram's terms for third-party clients, public channels in Fork may show sponsored messages provided by Telegram. Telegram selects and serves them under its own policies. The Company does not share your Personal Data with advertisers and does not use it to personalize advertising.

8. International Transfers of Personal Data

The Company is incorporated in Abu Dhabi, United Arab Emirates. If, under applicable law, Abu Dhabi, United Arab Emirates, is deemed to be a jurisdiction that does not provide an adequate level of protection for Personal Data, the User’s consent to this Privacy Policy shall constitute the User’s explicit and informed consent to the cross-border transfer of Personal Data.

The primary servers used by the Company to store and process Personal Data are located in the Netherlands.

We will take the measures required by applicable data protection laws to ensure that the transfer and subsequent processing are lawful and that appropriate safeguards are in place.

Depending on the circumstances, these safeguards may include:

  • transferring Personal Data to a country recognized under applicable law as providing an adequate level of protection;
  • entering into appropriate contractual arrangements;
  • implementing appropriate technical and organizational safeguards; or
  • relying on another lawful mechanism for international data transfers.

9. Storage, Security and Retention

9.1. Where We Store Personal Data

The primary servers used by the Company to store and process Personal Data are located in the Netherlands.

Depending on the nature and purpose of the Processing, Personal Data may also be transferred to and processed in the United Arab Emirates, including in Abu Dhabi, where the Company is incorporated and registered. Such transfers may be necessary, for example, to enable the Company to provide, administer, maintain, and support Fork and the services, as well as to comply with applicable legal and regulatory requirements.

9.2. How We Protect Personal Data

We maintain technical and organizational measures designed to protect Personal Data against:

  • unauthorized access;
  • unauthorized disclosure;
  • unauthorized alteration;
  • accidental or unlawful destruction;
  • accidental loss; and
  • other unauthorized or unlawful forms of processing.

Depending on the nature of the Personal Data and the risks involved, these measures may include access controls, authentication, encryption, network security, monitoring, logging, backups and other appropriate security measures.

9.3. How Long We Keep Personal Data

We retain Personal Data only for as long as reasonably necessary to:

  • provide and maintain the Services;
  • fulfill the purposes described in this Privacy Policy;
  • comply with legal obligations;
  • resolve disputes;
  • enforce our agreements; or
  • protect our legal rights and legitimate interests.

Different categories of Personal Data may be retained for different periods.

When Personal Data is no longer required for these purposes, we will delete, anonymize or otherwise securely dispose of it in accordance with applicable law.

When you delete your Fork account, we delete the Personal Data associated with it within 30 days of a verified request, except where Section 12 allows us to keep it. Aggregated or anonymized information that no longer identifies you may be kept after that.

12. Deleting Your Account and Personal Data

You can delete your Fork account and the Personal Data associated with it at any time:

  • in Fork: Settings → Privacy and Security → Delete Fork Account, then confirm the deletion in the chat with our authentication bot;
  • without the app: open the link to our authentication bot given at https://fork.talk/delete-account in any Telegram app and confirm the deletion; or
  • by email at supp@fork.talk: we will reply with the same link, which confirms that the account is yours.

When you confirm the deletion, we delete your Fork account right away and sign you out of Fork on all your devices. We erase the Personal Data associated with your Fork account 30 days later and let you know when this is complete. If you sign in to Fork again before then, your account and data are restored and the deletion is cancelled.

Your Telegram account is separate from your Fork account and stays when you delete your Fork account. To delete your Telegram account, use Telegram's page at https://my.telegram.org/auth?to=delete. Telegram performs this deletion under its own terms and policies. Deleting your Telegram account does not by itself delete your Fork account. To delete both, also use one of the options above.

We may retain certain information where this is necessary to:

  • comply with a legal obligation;
  • prevent fraud, abuse or other unlawful activity;
  • protect the security of Fork;
  • establish, exercise or defend legal claims; or
  • comply with other lawful requirements.

Where information is retained for these purposes, we will not use it for unrelated purposes unless permitted by applicable law.

  • the way we process Personal Data;
  • applicable laws and regulations;
  • our security practices; or
  • our business or operational requirements.

When we update this Privacy Policy, we will publish the revised version through Fork or on the website associated with Fork and update the “Last Updated” date above.

Where required by applicable law, we will provide additional notice or obtain your consent before material changes to the processing of Personal Data take effect.
